Western Digital seeking injunction to stop Toshiba auction

Western Digital has applied to the Superior Court of California for an injunction to stop the sale of Toshiba’s chip business.
“Attempts to circumvent our contractual rights have left us with no choice but to take this action,” Western Digital CEO o Steve Milligan, “left unchecked, Toshiba would pursue a course that clearly violates these rights.”
Last year, Western Digital bought SanDisk which had a jv for two fabs with Toshiba.
The trigger for WD’s application for an injunction was being left out of a Japan government-led consortium to buy the unit.
Yesterday WD was reported to have submitted a revised bid that did not meet with approval.
Toshiba still says it will make a decision on the auction by June 28th.
